(Querist) 06 March 2014 This query is : Resolved
sir, I was appointed as B T asst in a tamil nadu aided school in 21-09-1992. I got two incentive and selection grade. In 12-3-2004 i got promotion as p g asst.My pay is very less than my junior ,appointed in 20-10-1992 as B T asst. He got two incentive recently and spl grade. The headmaster says that I cat not compare the salary of my junior because we are in differnt post (.He is junior in cadre and junior in service.) please kindly help me
Sudhir Kumar, Advocate (Expert) 07 March 2014
for getting equated please make sure that junior:-

(i) has not put in more service?
(ii) is not carrying higher pay from lower post when he got promoted.

(iii) He should be holding not only same post but same seniority list also.

(iv) High higher pay should not be s result of any Spl Pay/ Personal Pay/ ACP etc.

If such is the case, your pay can be fixed at par with your junior provided any special increase is given as Expert Sudhir quoted.
T. Kalaiselvan, Advocate (Expert) 07 March 2014
I agree with the experts opinion.

Stepping up is permissible only in respect anomaly arising from pay fixation, not otherwise.
