Dear Sir/Madam,
My wife had pregnant and my wife treatment under doctor from 9 month, after delivery she have Nimoniya and typhoid but doctor say everything is control don`t worry but after 3 day delivery she had expired in hospital. that time doctor call police for his safe & side. police pressure on me for postmortem. we already give TEHRIR in police station against doctor negligence. which is carbon copy also i have.
but three day after police me and my brother sent jail because doctor fill case against section 147/323/504/506/427
and police take no any action on our TEHRIR
Many person say to me for cross case against doctor but after this incident my confidence level break and i didn`t want to involve any case so our office colleague suggestion for compromise and i agreed. isiliye maine abhi tak koi cross case nahi kiya.
but when he go to doctor for compromise then doctor say IMA (Indian Medical association)involve in this case so if he say to sorry and give some rupees as penalty then i withdraw this case.
Dear Sir/madam My soul not to permission this.
so kindly give answer my some question.
1. Can i cross case on behalf of TEHRIR ??
2. Can i go to Consumer Court against
doctor negligence and what is % of
success ??
3. I m belong middle class family and i
have 4 month baby.
Cross case karne se kya fayda hoga ??

I think you are not saying full facts.First of all tell why Doctor have filed a complaint against you alongwith your brother under sections 147/323/504/506/427.

Sir, do not worry about your loss, yes it is happened. there is always remedy available for the damage. i request you to file a case against the doctor for negligence of service immediately, then you will see the rest of consequences, you give all your evidence to substantiate the case and the percentage will be high.

Mr Bansal has put a vary valid question. However you are free to go to Consumer Court as well as file an FIR against the Doctor as well. Cross case aap faiyde ke liye nahin but justice ke liye dale to better hai !

I think you are suppressing the real incident.when you saw that the police is taking no steps why you didn't inform sp by post?
why doctor will go to file a falls case against you?
why you didn't go to consumer forum for taking action against doctor,when you have lodged an FIR.
If you are in actual footing why the question of compromise arises?
cross case won't help you,tell me the real fact and get the best suggession.

when my wife death in hospital then there are many people come from our family & neighbors & vahan per kafi garmagarmi ho gayee thi with doctor & police because police favor to doctor. then police suggest if u have any problem with doctor then u can FIR & body sent to postmartum. so that time we give TEHRIR & body sent to Postmartum.
It can be possible That IMA/Wellwiehr of doctors suggestion to doctor if he file FIR against me then case will be weak and that time i am also not a good condition as mentaly so..
And i am ready for compromise because i m single responsible person in my family and now i have newborn baby also.
and many people suggest me that court main jaoge to baad main bhi compromise hi karna padega or ho sakta hai case lamba chale, case ki date main kafi time or paise kharab ho jayega so it will be better if you agree now for compromise. so that time i ready ....
So i tll to everything which is happen with me.
As per your experiences may i go to cross case or consumer court ??
and also please tell any time period limit for cross case ?

ALL ARE EQUAL BEFORE LAW YOU SAID YOU ARE CHARGED BY THE DOCTOR,YOU FEEL ACTUALLY THE DOCTOR DID WRONG, YOU CAN PROCEED WITH COUNTER CASE AND ALSO FILING THE CONSUMER COURT ALSO FOR NEGLIGENCE WITH THE SUBTANTIATE DOCUMENTS, IF YOU FEEL REAR YOU CAN JOINT ONE CORDIAL ORGANAISATION AND MOVE WOTH THEIR BOLDLY.
