Kindly provide me advice

My wife took my jewelry and belongings by threatening me with the police when I called them during a violent confrontation at my home. The incident is now well known in the society where we lived, forcing my family to sell house. I left my hometown business for marriage but wasn’t allowed to return and haven’t earned since.

I have video evidence of the events. The 498A chargesheet was submitted two months ago, but I haven’t received summons. Local advocates are delaying to provide certified copies for quashing, and the court is 600 km away from my home.

Can I file for contested divorce on the basis of cruelty as she wrote in police statement that she does not want to live with me now? Can I also file an FIR or case for defamation and recovery of my jewelry? What about 498a quashing?

You can apply for the certified copies you want online. After receipt of the summons, you deny the allegations against you and then file the divorce case.

If you feel that the situation is no more tolerable, then you can very well decide to file a contested divorce on the grounds of cruelty.
If you have evidence for she taking away your jewels you can lodge a criminal complaint for the offence of theft against her and seek recovery.

Did you file police / court complaint when your wife took the jewellary ?
Whether the concerned court is 1 km or 600 km you will have to contest it there itself where case is pending untill you can get it transferred to the court convineint to you.
