Labour Problems due to union

Dear All's
I am a Manager-HR in Facility Mgr Co. & we have a contract of housekeeping & bus maintenance service at DTC Bus Deopt in Delhi, we have facing the labour problems that are as below:-
- Irresponsibility in the work.
- Un authorised absenteeism.
- Not follow the order of senior
If we told the worker regarding above matter and give the warning / absenting / suspension letter to the worker, they go to the Union and file the case in the labour department, we are every time go to the labour department and sort the case, but we are facing regularly this problems.
Due to that we are facing huges losses in term of service as well as monetary.
We are requested to all the respected advocate / members please help us to give better solution of this matter.

approaching of labor department by the workman or union is their fundamental and statutory right, you can not stop or put any restriction but certainly being employer you has certain administrative rights and powers.In case, any workmen indulges himself in any such misconduct as you have mentioned in your query, you have a right to initiate disciplinary proceedings, it is your prerogative and right.Neither the union nor the labour department has a right to interfere in your this right.You can flatly refuse to negotiate or challenge their action. In case, union and/or workman is aggrieved with action of management they have a right to challenge that action in appropriate forum. So it is for the management to decide. All options are open for it. However,my advise is that always get in touch with your consultant, who is the best person to advise you.

give them written notice regarding such irregularities and if the reply was not satisfactory or vague, you can start disciplinary action by initiating proceedings against the concerned employee
