Land acquisition

(Querist) 20 January 2014 This query is : Resolved 
A writ petition against land acquisition was filed in 1997 and quashed in 2009 favouring the petitioner by Madras High Court. But till now the state government has not filed any appeal. Whether any time limit is there to file appeal to Supreme Court by Govt. If so, what is the period of time limit? Can the Govt. can condone delay even after 2009? For how much period the Govt. can condone the delay? Whether the govt. can go appeal now?

Limitation of filing of appeal is 90 days, which may be condoned if the appellatte court is satisfied

Yes I agree with the experts. Since the land acquisition is quashed by HC, owners can approach permission for building plan etc.,to enforced their right. It also looks to me time limit has crossed even beyond the limitation period of 3 years also. Consult a local lawyer in your area about the prevailing guidelines on the same.
