Respected Experts,My house situated at Vill Chhatikara, Mathura, UP is situated at NH 2 from Mathura to Delhi and NH 2 is being widened by NHAI from 4 lanes to six lanes. The ancestral house about 350 y2 we were given by our ancestors was not having any entrance except from the NH 2 side. For this my Grandfather during 1960 deposited Cash worth Rs. 50/- to some PANCHAYAT whose receipt is enclosed in the attached file in token of purchased the land in front of house for preparation of House for residence. The official records available online at Khasra No 763 & 765 of Mathura District, Tehsil- Sadar, spell that land of POKHAR i.e., the non-cultivating land under water. The Special Land Acquisition Officer court at Mathura, who is designated authority to dispense cases of land acquisition and compensation, clearly states that since the land is POKHAR in government records, our plea with said receipt is not justified. We had four rooms constructed on that land with the approximate cost of 6 lakhs during 1998. I request you to advise how I can get compensation for the structures in my possession and being demolished/ acquired by NHAI in near future.

How did you respond to any notice for acquisition of said land with your house on it ? What is the compensation offered ?

Sir, my parents resides at village. They are not literate enough to respond to any news paper notice. No written notice served to them till now. However, I remain deployed in many naxal,NES region and terrorism affected areas of India, serving eminent Paramilitary Force. No copy of any notice available with me. No compensation offered by any authority instead it is being said that the house land is on POKHAR (Underwater, non cultivation) land and for that no compensation lies. Please guide how I can obtain copy of notice and thereafter compensation.

I remember press notice in Times of India for such acquisition in the past for NHAI; If you did not have any title / ownership, what relief can be expected ? You may only seek status information from the concerned LAO lacally;

If the land records show that the land is Pokhar and do not show any structures on it, u may be regarded as an encroacher having an unauthorized construction on the land. Such structures do not get any compensation. On the other hand the structure may be removed by the authorities as illegal one. Did u pay any house tax to local authority such as the village panchayat or municipality? If so you may put up an application for compensation for the structure based on the tax receipts. But no guarantee of success. Trial costs nothing.
