Land earmarked for road not transferred to municipality by builder

Sir
From: Hyderabad Andhra Pradesh
1) We are tenants (50) of an Appartment residing in five floors.
2) Originally the land is an Agricultural land. Our builder is having only cart track way in it.
3) He built the Appartments in one side of the land and kept rest of the land with himself.
4) Our builder has registered the flats to all of us by showing 33 feet road (in the sale deed as well as in the plan) in front of our Appartment.
5) But he did not transferred the land to Municipality in writing.
6) Now the Municipality is not developing the road in front of our Appartment like laying of BT road etc. on the plea that the builder has not transferred the land.
7) Please show a way. How to convince the Municipal Authorities. Is there any specific Rules or any so in this regard.

MUNICIPAL CORPORATION APPROVED THE PLAN GIVEN BY BUILDER I.E WITH 33 FEET ROAD IN FRONT OF THE APPARTMENT. BUT BUILDER IS NOT YET TRANSFERRING THE ROAD PART TO THE MUNICIPAL CORPORATION. HENCE THE PROBLEM

Has builder obtained local development authority approval for making apartment? Usually all city development authorities insist on the builder to apply for approval of site plan showing boundaries with specified approach to the site from the road. Without transfer of the agreed part of land prior to bringing up the apartments the the development authorities would not have given its approval of the plan

You have stated that the builder has registered the flats in ur favor. Hence u are all owners and not tenants. Have u registered ur selves as Housing Society or not? Better do it if not already done. This will give u more powers to deal with the builder as well as the municipal Corporation. As regards ur query,without transfer of the road plot to the municipal corporation they will not be responsible to maintain the road. Hope ur builder got the lay out of the land approved by the municipality.
