Land lord asking to vacate the flat

(Querist) 13 March 2016 This query is : Resolved
Sir I with my family is residing in a rented flat in a building for the last 13 years paying the monthly rent in cash and there is no rent agreement and now suddenly the land lord is asking us to vacate the flat as he wants to run hotel in his building. Now is there any relief in Law for us to keep on enjoying the peaceful possession or we have no choice but to vacate the flat immediately in response to the decision of the land lord ?
Devajyoti Barman (Expert) 14 March 2016
Where are you from? Every state has its own Rent Act which frames laws for the protection of tenant.
Reasonable/bona fide requirement of tenant is good ground for eviction of tenant.
However till the tenant is lawfully evicted from suit premises he can enjoy the property.
So you may refuse to vacate the flat now and stay there until and until unless the landlord gets the eviction decree from court which takes time.

Well advised by the expert Devajyoti Barman , agree with the advice.

The landlord has to have a valid and justified reason to get the property vacated.. did you get any notice from the owner? if yes then answer the notice with the help of a lawyer.
