Land lord not allowing to do business of partnership conceren where a partner is a tennant

Sir we a holding a rented room at kolkata at netaji subhas road.the rent receipt is by my cousin name and he is a partner of our business.the sales tax ,income tax and proffesional tax has been informed and necessary ammendmants has been done on the concerned certificate's. Previously all the rent was paid in time .but due to unavoidable circumstance this time the rent was not paid as the darwan did not give the receipt and the payment due as on date is for 5 months. now the land lord is asking for the partnership deed and voter card ,pan card. reason saying that this is for the rule of kolkata . secondly the land lord is saying that the place is being sublet by the person who is a partner.of a small trading company . all previous payment has been made from company account by cheque but this time he has asked and taken the rent receipt back from me . in this regard please help. thanking you sanjay shah (m) 9831100775

If not hired as a shop or office, rented room is for meant residence, not for business. So, the landlord has every right to restrict you from doing business in a residential place.

Try to have amicable settlement with the landlord and have the rent receipt / lease / rent deed in the name of the firm.

Once again I Confirm the advise of Senior Expert Mr.P.S.Dhingra If the Residential Place is to be Used For Commercial Purposes there would be Changes in Tariff and Taxes Etc For example the Electricity bills Etc.Your Land Lord holds all the Right to deny the Misuse of his place For which it had been Rented that is for Residential Purpose Only.

You have stated that all the rents were paid in time but this time the due remained unpaid for 5 months, therefore there is sufficient cause which earned the wrath of the landlord (?), you have created problem for yourself by defaulting the rental payment. Even now the situation may not be out of hands so better go for amicable settlement and close the matter.
