(Querist) 18 January 2015 This query is : Resolved
Hello Experts,

I am Bhaskar from Bangalore, My dad saved 10 lakhs from hard working 20 years. We have seen a land in Bashyam Nagar (Near Prakash Nagar,Bangalore) of total Land Area 749 SQFT(Includes 2 Small damaged house and vacant land). We got to know about this land through 2 brokers Vari and Viji, Land Owner Dasaratha agreed to sale this 749 SQFT land for rupees 39,50000/- advance amount rupees 10 lakhs(5 lakhs in cash + 5 Lakhs by Cheque) we paid to Dasaratha and His friend suresh(Witness as well for Dasaratha end). We paid amount on 6th August 2014 and after 1 month we got to know somebody occupied one of that broken house stating we need 50% share on this house and legally they have sent notice(litigation) to Dasaratha lodged a local police compliant. We got shocked about this and asked Dasaratha to pay back our agreement amount 10 lakhs, he kept on promising that I will pay in 1 week, months..... He didn't paid at all. We want to legally take action on him to return our 10 Lakhs rupees. I want to know how many months that agreement is valid? Family is in complete depression. We don't have any support politically or Locally. we would like to take this case legally only. Need your valuable suggestions as early as possible.

we have documents like

1. Agreement copy Original with hand written from Dasaratha signature on each agreement paper.

2.Recorded Voices of his false promises.

You should file a criminal case of cheating and forgery against the seller.
Besides this, file a suit for recovery of money.
Engage a local prudent lawyer and proceed in a professional manner.

In Bangalore such type of heinous crimes are abundantly prevalent. It is for the buyer to beware. You should have taken an opinion from a lawyer earlier itself before you have entered into the sale agreement. Now the option before you is to lodge a complaint with the local police as well as to file a money recovery suit in the city civil court.
