Language of lawer court

Please solve my query quickly.

today in one case under sec.138 of N.I. act the advocate of accused demanded to translate the whole suit in vernancular language i.e. in GUJARATI, in JMFC.

We r generally doing court proceeding in english.

Is there any article/ section/ or latest judgement that make compulsion to do so?

Pl source me judgements in favour and against us.

It is very urgent for us.


judge also urged us to do so if we fail to prove that there is no such provision that bind us to translate the suit in Varnencular...

there is needed some judgements.

I DON'T THINK REGARDING TRANSLATION TEXT ANY JUDGMENT IS AVAILABLE,SOME TIMES IT IS WELL ACCEPTED PHENOMENA TO TRANSLATE THE ENGLISH INTO OWN KNOWN MOTHER TONG OF ACCUSED TO GET MORE CLARITY ABOUT COMPLAINT.EVEN THE JUDGE HIM SELF READS IN ACCUSED LANGUAGE WHILE EXAMINATION,313 TRAIL....

I think it is repeated question. I have already answred for this.
Eventhough once again an answer for you. If the other side is not well acquinted with the english language and he is well versed with the local language then it is our duty to supply the plaint in the local language. U need not to go for any rulings because it is a practice.

It is true if the party represented in person - no Advocate to Accused

However the accused is represented by advocate , Advocate can explain the Contents of the Complaint in Gujarathi to the Accused

It is better to translate and supply the Copies to the Accused , as directed by the Court !
