Lanlord vs tenant

Dear Sir

We are tenant and leaving in a house last 3 years. There is no agreement for this year given by our landlord.

But our landlord forced us to empty the house next 15 days.

Due to examination we are unable to change the house before 31st Mar.

Pls advise wht to do now

without agreement which landlod wil;l permit youto occupy his place?

We are sending cheques everymonth by courier. He never give us rent receipt

the fact that cheques have been issued in name of landlord and has been encashed by landlors should strengthen your case . contact a local lawyer

You an file RAE suit, Contact Local Lawyer to issue Notice, accept rent by Cheque, and get Court Order, he cannot Empty your rented house.

No landlord can evict you forcibly. If you are capable enough to maintain your possession till next 2 months then I suggest not to take any legal action and humbly go on pleading to vacate on 01 April 2012 but if you feel some foul play and cannot sustain his pressure tectics only then go to Rent Controller and seek stay order against vacation which shall even pass your 2-3 years in the same house under the same terms and conditions as are prevailing.

Whatever be terms of the lease or the lease may have expired, the landlord does not get a right to evict a tenant except by due process of law. If you want to gain you should file a suit for permanent injunction against forceful ejection.
