CAN A DIVOREC PETITION IS FILED IS SUTAIBLE IN THIS CONDITION THAT 125 MAINTAIANCE IS PENDING {REVISION} SHE ALSO WANT TO GO THROUGH DOMESTIC VOILANCE AND IN CRULITY COMPLAINT IS IN PROCESS IS THIS IS SUTAIBLE THAT WE CAN FILE DIVOREC PETITION WHAT EFFFCETS IS ON OTHER CASES .

hi,
y u hv every right to file as she also hs evey right to file some cases against u at any point of time , if u file now a divorce case against her then she must agitate b4 that fora with a prayer for alimony in that case the amount will be high as ordered in 125 cr.p.c. case.
So, u talk to ur LAWYER & PROCEED.
I THINK IF U WANT DIVOCE ASAP THEN U CAN FILE A DIVORCE CASE.

There is no problem in filing divorce petition.
she lodged Domestic violence and cruelty so my advise is to you try to settle the problem outside the court ,i mean take divorce from her and further give her lump some amount as a final maintenance and also put a condition in divorce petition that in future she will not ask for maintenance for that hire a good family lawyer.
