Lease deed

(Querist) 29 December 2010 This query is : Resolved 
Hello Sir, i have a own land which i gave on lease many year before, the agreement is also made that time. but that agreement is complete before 4 years, after that i dont renew that agreement but take rent from the party and also gave receipts till now, but now i want to vacant that land but lease holder not agree?? wht the solution to make land vacant. plz help.....

i think you have lost the golden chance to vacate the land when period of lease expire.As per your word you are issuing reciept of rent till now it mean earliar leasee was contratual tenant after thatleasee was not asked to vacate the land.Therefore as per conduct of parties he became a statuary tenant.Now you have only remedy to vacte the land as per tenecy act of your state.My oppinion is based upon punjab security of land tenuers act 1953 and The Haryana urban(control of rent and eviction)act 1973.

Send notice u0s 106 of the Transfer of Property Act and after one motnh file suit evicton of the lessee unless some state act prescribes another procedure.

in case if u have a influvance in police,go and lodge a complaint aganinst to the tenent general false complaint,or other wise in case if it is failier,issue notice u/s 106 of t.p. act after that u have to file suit for ev iction against the tenent
