Querist : Anonymous (Querist) 05 October 2010 This query is : Resolved
Hello
I have given my land on lease for 30 years to a charitable trust( for running a school). I want to know wheather a Trust/school can claim ownership right on land on ground of public interset after 30 years. Can i get my land after 30 years if i want. Can i get the building and land after expiry of lease. please help.

The lessee can not claim title on the leasehold property as such claim is clearly barred by the Rule of Estoppel. Yes, you could definitely get back the leasehold property after the lapse of the lease period if you do not renew the lease any more. As it is a public trust it will be better if you start corresponding with the lessee several years earlier from the date of expiry stating your intention not to renew the lease any more.
