Leave for upsc examination

Sir,
i am permenant employee of State bank of india, working in coimbatore i need leave for 6 months from may to october for 6 months for upsc exam (IAS IPS), my service conditions entittled me for study leave of 6 months for any examination purpose. if my leave apllication rejectted by my higher authority where should i approach to get remedy or if there is any chance of me be punished by the bank if i take remedial measures.

Leave is always at the discretion of the management in the exigency of service, not a matter of right. No remedial measure or legal recourse, except to convince the management about your career development or to absent yourself. However, for unauthorised absence disciplinary action cannot be avoided that often leads to termination from service. But, if you are sure about your success in UPSC, you may risk your career in the existing employment.

You have no remedy.
Probably you are under misconception about study leave. Study leave is admissible
(i) For employee with 5 years service
(ii) For academic courses.
(iii) if course in the opinion of deptt is useful to the present post on which the employee is working.
(iv) If employee undertakes not to resign upto three years of completion of leave.
You better check if the leave rules of SBI are different.

you have not specified whether you are a workman employee or officer employee since the procedure and regulation are different in each case. However,please note the following. 1) you are not entitled for study leave since you are not pursuing the course( i.e.you are preparing for competitive exam)which is beneficial to bank service. 2)When you are applying for civil service exam, you should mention your present service details in the application form and also inform to bank Management that you have applied for the civil service exam. 3) Though bank has right to refuse your leave application, they can't do so if you are preparing for your better employment avenues,this is your fundamental right. 4) in case of refusal of leave, intimate the management that you are required to prepare for exam and treat the period of absence as leave without pay. Bank can't take action on the ground of unauthorized absence since you have intimated your decision to resume to duty after your exam. 5)keep record of your application for leave, the purpose of leave and bank management's decision to grant or refuse your application for leave. 6) also take assistance of your Union or Officer Association, they will guide you further in this matter.
