Supreme Court Middle Income Group Legal Aid Society
The scheme is available under the Supreme Court Middle Income Group Legal Aid Society, a society headed by a sitting judge of the Supreme Court with the Attorney General of India as its ex-official vice-president. The society comprises 30 prominent senior advocates, besides 100-odd advocates on record.
Under the scheme even a senior advocate if engaged by a client can charge a maximum of Rs 9,000 for three days of hearing or for the entire case. The amount would start from as low as Rs 3,000 depending upon the stage of the petition at which it is argued.
Who can avail:
Anyone whose annual gross salary does not exceed Rs 7.5 lakh or a monthly gross income not exceeding Rs 60,000, can apply to avail the Supreme Court Middle Income Group Legal Aid Society scheme.
How to avail the scheme:
Any person qualifying in the economic bracket criterion mentioned above and desirous of availing the services of an advocate empanelled under the legal aid scheme has to approach the secretary of the society by filing an application. The application is scrutinized and if found suitable, an advocate assigned. The society's office is located at 109, Lawyers Chambers, Post Office Wing, located within the Supreme Court complex.
The Supreme Court Middle Income Group Legal Aid Society scheme has been available since 1995, but not much in demand as many litigants were not aware of its existence. The Supreme Court Middle Income Group Legal Aid Society has decided to promote the scheme to provide affordable legal aid to middle class familes in need of the same.
The workflow of this scheme is briefly as below:
1. An applicant who has a case to be filed in the Supreme Court has to file an application with the secretary of the scheme
2. One has to provide complete and full documentations like certified copy, copy of petition, lower court orders etc.
3. Applicant indicates any 3 names both in relation to the Advocate-on-Record or the arguing Counsel or the Senior Counsel as the case may be in the order of preference from out of the panel maintained by Society
4. The Secretary determines the approximate amount necessary for the purpose of such preparation of the Court record.
5. When all papers are received they are be assigned to the Advocate-on-Record of the choice indicated by an applicant.
6. Advocate after perusing them opines that this is not a fit case for leave to appeal to the Supreme Court. His views regarding eligibility are final.
7. Applicant pays the fees and case is filed under the scheme.

There cannot be any better free advise on the net. It appears that you are not getting free legal aid (which is available to those who are prima facie innocent). It also appears that you are unable to afford an advocate and still go to the extent of calling you minor son as greedy, questioning the judge’s wisdom in calling for the evidence, questioning the correctness of paltry sum of rs 5800 given as maintenance, want the advise if she can appeal against an order favourable to you.
All this indicates what?
Somewhere you may be wrong for having caused this situation. Average Indian women do no like to go to thana against husband unless compelled.
If you cannot afford litigation or maintenance than peace is the best option which is never costly and available simply by shedding male ego.
Better try amicable settlement if you can.
