Legal for single woman to have child via artificial insemination?

(Querist) 13 May 2014 This query is : Resolved
Hi,

My query is as follows:

Is it legal in India for a single woman to have a child through artificial insemination done using an unknown donor’s sperm?

If yes, for official purposes such as birth certificate, school records, passport and other legal documents, what information should be provided where the father’s name is asked?

Also, if this is legitimate, is there any other advice you would give from a legal perspective to a woman considering this option?

I will appreciate your assistance on this subject.

Regards,
IM

1. Yes you can. Even unmarried women have a natural legal right to bear children. The donor's name would be mentioned in the hospital records and the same name can be used as the father's name as and when needed.

2. Contact this lawyer for further private consultation.

Mother.s name also permissible as initial of child.

There is no legal bar on an unmarried woman going for AID. A child born to a single woman through AID would be deemed to be legitimate.(AID is Artificial insemination donor.
There are no clear guidelines for the groups other than married couples, who want to bear child like, homosexuals, divorced or single. Recently CARA (Central adoption resource agency) has sought to ban gay and lesbian couples from adopting childrens, in its newly framed guidelines.
Now to your question:If yes, for official purposes such as birth certificate, school records, passport and other legal documents, what information should be provided where the father’s name is asked?
the name of the donor of semen shall be the father's name of the child.
Once it is considered as legitimate all other issues of illegality on the subject never rises.
