(Querist) 16 April 2013 This query is : Resolved 
My co-brother (sister in law husband) owned some properties and he deposited all original documents with his brother .
Unfortunately he died and my sister in law is bestowed with one son who is minor now.
Now my sister in law wants to transfer this property either to his son's name or sell off.
Please guide us how she can claim this property as she is having only attested copies as originals are with her brother in law.

file police complaint against brother in law if he refuses to return the original documents of property . before filing complaint send him letter by regd post ad asking him to return the originals . if he fails to do so then only file complaint

how can she transfer the properties on her sons name thus she already registered first enquire

In the meanwhile, you can approach any local advocate to insert a public notice stating that the properties belong to your deceased husband and any authorized attempt to sell/buy the properties are not valid transactions and the purchaser can not get a valid title to these properties.

fACTS TOLD:
HUSBAND DIED LEAVING A WIDOW AND A MINOR SON.
DOCUMENTS OF ESTATE ARE WITH BROTHER OF THE DECEASED.


BUT EXCEPT WIDOW AND A BROTHER QUERY DOES NOT SPEAK ABOUT PRESENCE OF OTHER Ashabul faraiz -The sharers whose shares or proportions have been fixed in the Quran.

NO PROPER RESOLUTION OF QUERY IS POSSIBLE
