Dear Lawyers club india,
1. we are 3 brothers and 1 sister, myself/elder brother and sister married. 1 brother of my age is left for marriage. 2. After my mother expired in 2000, we 4 together got a legal heir certifcate in all 4 names for property concern(no mind of partition at that time)without any consent nobody can proceed to sell property. 3. Now we are planning to do partition mutually among 4. but elder brother is creating a mess, delaying the issue where i'm required my share to settle myself in mumbai for past 4-5 yrs. where my elder sister and younger brother is also willing for the same.4. Past nearly 11-12 yrs, nobody knows the income on all the property(LAND/House rents) nor been shared among others till date. 5. now we had sick of the issue , planned to end this property issue this coming months in any way. 6. No proper response for telephones/SMS/Letters till date. 7.we can't waste much time at vizag for this settlement where it'll affect our job schedules. 8. he is just sitting at home and enjoying the property income, no job...nothing.
Kindly help me with the best solution for fast process in this problem please.

isue legal notice to brother . contact local lawyer . file suit for partition

Do as Ld.Sethi Sir said...in addition to suit for partition file for rendition of accounts - to get the lawful share of the income accumulated from the property all these years from which you've been kept out.
Sethi Sir is in Mumbai - he might guide you best.

Satish,, try to convince ur brother for amicable partition once again and get register the partition deed.
If u once enter the court it will consume much time for one or other reasons.
Filling of suit for partition is ultimate remedy.
