Sir,
We were residing at chennai until July 2008, and moved to Mysore in July 2009 end
My father had cancer and we took him to chennai for treatment in June 2009 and he died at an old age home ( aged 84).
We ( only son and daugter )applied for Legalheir certificate for his family pension
for my sister who is unmarried and unemployed aged 42 yrs and stays with me at Mysore .
We submittd the same to VAO at chennai and told him that we are currently at Mysore and had vacated the chennai house 6 months back , he says it isnt possible to issue ,
Though I enclosed the death certificate of my father and mother , as well as the ration card copy for his perusal.
Please advise me , what i shd do now.

You could have filed the application at your native VAO office, if you are native of madras then you are right.
I think he is expecting money.

Mr. Ananth,
The VAO will issue legal heir certificate only after making some inquiries in the where you are living. In your case onlyVAO of Chennai can issue the certificate since you and your father last lived there.
VAO Mysore would not know who your father is as he cannot find this from his enquiry in Mysore.
I suggest you go to VAO Chennai, fix up a prior appointment with him for enquiry and give the required information. He is required to take statements of yourself and your sister and any other persons of the locality ( if he so desires) to ascertain that you and your sister are the only legal heirs of your decesed father.

Mr Ananth! the suggestion of Mr GVSJ Rao is correct , you are having record of Residence at Chennai and the local residents will give statements that your family was residing there till July , the VAO can aslo certify that you lived there till July and issue Legal Heir Certificate!

Dear Shri GVSJ Rao,
Thanks for your advise . I did filed the
application at chennai , VAO where i resided and submitted my proof of residence ie Ration card , and infact informed him (VAO) that i no more live at chennai for the past one year , and he nodded his head and said he will look after and asked me to meet him after 5 days. Now after 5 days he says he went there and checked at the place where we resided and was told by the current tenant that they have no idea of who lived there .and now the VAO is asking us the proof of the same, even though we our last address in chennai was mentioned in the Ration card, he isnt satisfied,
but people say he is expecting money , that why he is doing all these thing.
and further the VAO says he will mention in the application that we wernt residing there any more , if we dont pay him.
Though my late father was a Retd Railway
employee , with his photograph in the ration card is endorsed.
apart from this , we have taken sugar every alternate month as a proof of purchase...
inpsite of this he is doing all these .
Please advise me how to go about .

If he is expecting money then you take the services of any local lawyer and serve a legal notice to him or can use RTI Act and seek legal procedure and complications of your application. In both situations, you can get the desired results.
