Legal notice against an ex-employee

One of an ex-employees in the firm was fired for using fraudulent practices to implement a client's project. He was asked to resign immediately without salary or notice period, as the company had to take a penalty from the client for this work and also had to refund all the money paid to them.

This employee emailed the clients and has been posting derogatory stuff about company on public forums, which is hurting the company's image.

Being the HR, i was instructed to consult our lawyers and take necessary actions.

I have few queries:

1. What purpose does a legal notice serve?
2. If an employee is not staying at the address he had provided to us, during his tenure in the company, what should we do. Can we send a notice to his current company?
3. The employee was not paid for his last month's work. Will it have any legal implications for the company?

I suppose your company can well afford to pay the consultancy fee of a lawyer. So, why not consult a local lawyer, as you may have to consult him frequently on short notices in such type of cases.

I wish this forum could be of help. We ere Anyways going to consult a lawyer and then I came across this site hoping someone can actually help us with queries we should be asking our lawyer.

Instead everyone is suggesting me to go to a lawyer.

Dear Mr. Rao,

The term "help" itself denotes that it is meant for helpless, hapless and have-nots, but not as a free facility to the profit making organisations, who can well afford fee of even the costliest experts.

You would also kindly like to note that the experts here are not being compensated by the LCI or anyone else for wasting their valuable time, efforts, expenditure on salaries and infrastructure, broadband and electricity, etc.

That is why you were politely informed to hire some expert at local level, so that the time of experts could be spent in helping the other helpless people, who really need their help.
