Legal notice not sent as per statutory requirement under section 138 n i act

The Cheque was dishonored in the year 2008 and due to the shifting of the house i could not be able to send legal notice as per the statutory requirement but now i found the cheque along with memo of 2008

My query is:
1)whether i can send legal notice now?
2) what is the other remedies for above query

You can do nothing now except to personally contact to the concerned person and request him to issue you a fresh cheque.
