(Querist) 25 May 2013 This query is : Resolved 
An accused after being convicted in a cheque bounce case appealed in session court.The case was sent to lok adalat.On hearing date neither complainant nor his counsel could present before court due to they had to go out of station.After few days complainant approached his counsel to enquire about case.The counsel informed that accused has been acquited as case had been decided as compromise.Accused paid cheque amount to an lawyer standing on side of complainant.In fact that lawyer is unknown and was not engaged by complainant.Complainant got no money.Is there any legal relief for complainant?

case must have been referred to lok adalat only if both parties had agreed . in the present case complainant must have agreed to refer case to lok adalat .

you can obtain copy of order passed by lok adalat . the order must be mentioning name of lawyer appearing on behalf of lok adalat . did your counsel authorise his junour or another colleague to appear on your behalf .

if you have not received your cheque amount as per order complain to bar council against your lawyer
