Limitation act, Sec-5

Dear Seniors,
Can any one of you help me by coating me some authorities for filing set aside along with sec.5 (limitation act) the delay is more than 2500 days. It will be very helpful if i get any authority in my favor. The reasons for the delay is medical problem.

The SC has stated in no of cases that the provisions should be used to impart justice and not its denial. There are no of such citations as suggested above, pl go through them and prepare your case.

Delay defet the equity this maxim are apply in your case but Hon'ble S.C. held in several case that right to be decided after heard the party,you can follow the advise of Mr.Vishweshwar Rao.

Agree with mr.krisna.. He noted one of the case law.. You have to given a valid reason for your delay.. Otherwise your petition wil be dismissed..
