Loan related

(Querist) 18 July 2018 This query is : Resolved
My father took a loan in 2005 and it becomes N.P.A. next year due to non-payment of the same loan due to weak financial conditions of my father. Now my father passed away 3 years ago. I am minor at that time. I have no documents related to that loan. How I ask for the documents related to the Loan from the Bank. Orally I have demanded for the same but they can't give me yet. How I do ask in writing. Suggest a way.

If the Loan is thro Registered Agreement you could obtain the Copy from the Concerned Regitrar Office.

Other wise as a Legal Heir you have all the Rights to collect the details, first submit an written requisition to the Bank and take acknowledgement and after 15 days if no reply from the Bank you should serve a Legal Notice regarding the same.

Why should you go back, as it was a long NPA case. You have not given a satisfied answer as raised by the experts..
Sudhir Kumar, Advocate (Expert) 19 July 2018
whe3n loan became NPA in 2006 it is now a time bared debt. As appearing from your description the bank did not sue your father nor you. They cannot do so now.

why do you want this document. Just to facilitate the bank to now sue you by revival of limitation. If you ask this document in writing you will have to acknowledge the debt this will re-open the limitation.
