LOSS OF SHARE CERTIFICATE

I have lost my share certificate and in order to get a duplicate share certificate I have logged a complain and got a copy from police station and I have also put an ad in the newspaper and done a affidavit and notarized it!is this procedure sufficient enough to get a duplicate share certificate? do i need to do anything else? thank you

Which share certificate it is; Equities or society property?

Strange, if you were not you guided by your own society!

Consult secretary of the society and adopt procedure prescribed in the byelaws of your society.

Th efforts done by you are enough to claim duplicate share certificate provided you produce your title in the proeprty as well to the society.

i had gone to the deputy district registar office where the officer told me to make that affidavit of the lost share certificate and submit it to the secretary of the society.however,the secretary is telling me to get a letter written from the DDR stating that xyz person has lost this certificate so please issue them a duplicate one.but the DDR officer said there's no procedure like that!

Really strange, instead of going to the secretary for applying for duplicate share certificates and getting refusal from the secretary in writing with reason for denial by the secretary, you preferred to go to the DDR!

DDRs advice is right, if there is any truth in your story. The secretary has to follow th eprocedure laid down in the society byelaws.

You are unable to handle the secretary/society.


Submit in writing under proper acknowledgment.

Let society reply in writing.


Next recourse is DDR.

Submit the documents to Secretary and if the secretary objects approach DDR.

If no relief discuss with the local lawyer and move to court / file case seeking relief.

1. The Society has to mandatorily issue "duplicate share certificate" within 45 days, after receipt of the bonafide members (Applicants) documents, under the provision of bye-law no. 9(b), of the Model Bye-Laws, as published by the Maharashtra Coop. Dept.

2. IF the Society fails, THEN the Society (Secretary) becomes liable for prosecution under the Consumer Protection Act, for his negligence and deficiency and damages and compensation.

SIMPLE & PERMANENT SOLUTION:
File Complaint before the local Consumer Court (Forum), against the Society & Secretary, as above.

If you have submitted the requisite information/form/letter and secretary has not acted then he/society is deficient.


If you have evidence of approaching Secretary/DY.Registrar narrate and submit under proper acknowledgment.


Submit everything under proper acknowledgment.
