Hi there
I leave in mumbai powai area
Help me if u can
I stay in a tower which is 6 yrs old.
The builder occupys the top floor as residence and he has created a office space of himself on the space between basement and ground floor which he says he has approval.
Now the society has been since 1.5 yrs.
But bulider is not ready to pay the maintainance of his both premises citing that he has constructed the said building so he need not pay the maintainance.
All I wanted to know is there any law as such ?
If no than plz help what to do. As his bill is running into lakhs and also few of his family also occupy various flats on other floor and they also not paying up saying this is our bldg and so on.

builder is bound to pay maintenance for flats he is occupying . issue legal notice to builder . take recovery proceedings under section 101 of MCS act

the Association of the building, if formed, has to give notice and that also initiate legal proceedings.
