Hello all. My question is that what portion of salary of husband court consider while passing maintenance order to wife, gross salary (including all other allowances) or net salary ( excluding all other allowances).

Gross salary is considered as the actual salary of the husband.

Gross income (including income from other sources e.g. house property, business or profession, capital gains and other sources) less statutory deductions is being considered for grant of maintenance to wife/children/parents, as the case may be.

Though generally it is gross salary after standard/statutory deductions, it depends upon how the matter is explained and convinced before the court by both the sides during argument with supporting issues involving the salary income.
