This query is : Resolved
Can anyone tell me is there any act that forbids a wife from filing a maintenance petition either under section 125 of Cr.p.C or under personal law if the husband is dwelling in a foreign country?

i dont think there is any such law.
merely for the dwelling house is abroad, the husband can not skip his duty to maintain his wife.
if the couple is governed by Indian laws then certainly the husband can not skip.

Mr. Expert Kiran Kumar, Kindly understand my question. Is there any act that forbids under CPC or Cr.P.C such that that special act provides a forum to giver her justice Hence it is not to skip the husbands duty but to find out the forum for justice. She cannot have A FORUM OF HER CHOICE OR CONVENIENCE.
Please answer my query sir,

Neither kiran nor ajit correct and the specific act is Enforcement of maintenance orders Act of 1921 that forbids ordinary court to take cognizance and for the enforcement of orders.
