Maintenance and divorce

Dear All,

I am 48 year old, working in a private limited company and earned salary of Rs. 53000/- per month.

I am seperated since 2008 since my wife's misbehaviour (illegal contact), My both daughters are staying with her only.

first daughter aged 20 she finished her UG studies and working in a limited company, second daughter now in plus two, My divorce proceeding in coimbatore court.

My wife now refuse to give divorce and seeking maintenance.

Can i know about my monthly liability?, because last twenty years i am work for my family, wince 2008 only i start to save for my future, nothing belongs to me as if now.

Please help to know the liability of mine to my family..

You have not made any mention about monthly earning of your wife how she used to live and bring up your daughters without any financial support from you ever since the year 2008. Better make the picture clear.

You are liable for 1/3 to 1/5 of your current salary towards the maintenance of your wife.

Since your wife is unable to maintain herself and has no source of income so you are liable for maintenance allowance.

Court may order maintenance to the tune of 1/5 to 1/3 of your earnings to your wife. She has right to refuse divorce.

You are duty bound as a husband and father of the unmarried daughters to maintain them or to give maintenance amount every month for their maintenance, this is your responsibility and liability. If your wife is employed and is capable of maintaining, she is also equally responsible for maintenance of the children. The quantum of maintenance award amount will depend on the details you furnish before the court along with the details of her income (salaried or otherwise).
