Maintenance is admissible to a practicing advocate lady

I was married in the year 1991 with a girl who had studied M.Sc. Mathematics 1st Class. After marriage, I got her admitted to study in Chartered Accountancy and LL.B. She passed LL.B. with good marks and got registration as an advocate with Bar council of Delhi on 30.03.1996. She is a practicing advocate since then. On discovery of her illicit relations with her brother in law and his friends/clients, she went out of in laws house in my absence. After that, she filed F.I.R. u/s 498A and Maintenance Case u/s 125. I want to know whether she is admissible of getting maintenance from me. Both children are residing with me.

Unless you could show her income and professional standing, you are likely to pay if the court so directs.

if she is earning then she is not entitled for any maintenance.

Even if she is enrolled advocate and practicing lawyer in court if you fail to prove she earns sufficient income from her profession to maintain herself,you may be asked to pay her maintenance by amount her income goes short.

How could you simply blame her so badly.Saying having relationship with clients etc she should also sue you for damage.You should be a suspicious character.We should know her statements also.

you have not mentioned what is your monthly income and what is your wife income . number of judgements if wife is working and highly qualified she is not entitled to maintenance . draw attention of court to her qualification and fact thjat she has been practsing for 15 years . call upon her to produce her I tax retruns
