If a maintenence not paying to wife and children after divorce decree is passed ,is action amounts to punishable under domestic voilence act?

If maintenance is not paid even after the order of the court, then you will be booked for contempt of court.

Which maintenance, passe in DV case or case u/s 125 crpc or u/s 24 HMA?

All cases as stated above has different means for execution and punishment for default.

The court awarding maintenance has ample powers to get executed its order and there is no need to file separate case under DV Act just for the compliance of the order awarding maintenance.

If the award was passed while hearing the petition under DV Act, it is punishable under DV Act.

But, when the award was passed while hearing the divorce case, it can not be punished under DV Act.

Move EP, in the same court.
