Mandatory requirement of affidavit!!

(Querist) 16 April 2012 This query is : Resolved
is there any mandatory requirement of affidavit? If the deponent doesn't make statement in regard to "no concealment of material facts" in his affidavit, does it make the affidavit faulty?
Raj Kumar Makkad (Expert) 16 April 2012
Such affidavit may be designated as faulty if contrary is shown but this does not become invalid on this reason.
Shonee Kapoor (Expert) 16 April 2012
This fault can be rectified with the permission of the court.

Affidavit is of substance and not of form. There is no format for it. It is not necessary to declare that the deponent has not suppressed any facts. It is for the others to allege and prove that the deponent has suppressed any facts and that suppression has got a direct bearing over the other sworn facts.
prabhakar singh (Expert) 16 April 2012
It is sheer irregularity of form and it does
not invalidate it .A supplementary affidavit, though not required, can cure the defect if objections are boiling.
Raj Kumar Makkad (Expert) 16 April 2012
Even if anyone objects it, fault can be got rectified.
