Marriage broke in !0 days & wife harassing

Querist : Anonymous (Querist) 01 November 2018 This query is : Resolved
I belong to christian family...I got married in June 30 ,2018. in a Church, . within 10 days of marriage my wife left me and settled at her parents house..She enjoyed life with me, made me spent lakhs of rupees in ten days, later she used to start argument for silly reasons and make it complicated. Due to this elders got affected.. she says , she was forced to marry me by her mother. She used to search for reasons to avoid me i.e harrasing, cruelty etc & used to threaten me " will complain police ". 5 months passed away, now she is saying that she doesnt want to continue life with me. Her family is helpless & left the decision to my wife. i have filed restitution of Conjugal rights, yesterday..But my family doesnt want her , as they are scared of her ..again she may create false story and file false cases on us.

I have all the audio recordings , how she misbehaved with me, warned me, abused me, etc. i too dont want to continue life with her..

Somebody please help me out.

Unbelievable statement wherein you have mentioned that you have spent lakhs of rupees in 10 days married life.

Withdraw Restitution of conjugal right petition and file divorce petition on the ground of cruelty under section 10 the Indian Divorce Act.
If she agrees for divorce by mutual consent, you both will require to wait for 2 years to file divorce by mutual consent under section 10A of the Indian Divorce Act, that's the condition for filling such petition.

Pls don’t post as AQ and post with your ID and you can get many responses.
Your ID does not mean your email id or phone number etc and don’t post these.
Before attaching any document erase all names, logo, email id, phone number, address etc to maintain confidentiality.
Obtain proper legal opinion in writing from LOCAL counsel specializing in concerned field of law.

You may take help of elders of your family, competent and experienced well wishers, seasoned PIP’s, helpgroups, community leaders, NGO’s, experienced colleagues, associations, etc and find a very able LOCAL counsel specializing in concerned filed of law e.g; Family/Civil matters as in your case, and well versed with LOCAL applicable rules, precedence, latest judgments etc …. and worth his/her salt, can advise you and even help you.
Online discussions are not substitute to in person discussions with a very able counsel of unshakable repute and integrity specializing in concerned field of law.
There are such very able counsels at each location.
Check for such counsels at LOCAL e.g; Family/ Civil courts, HC, SC …

A good counsel as suggested above does not render bad advise after assessing the facts/details/record.

You being a Christian having married in the Church, I wonder as to whether you have already involved your Church Pastor/Priest concerned to see as to whether any amicable solutions can be found before resorting to legal remedies. Perhaps, you may do so, if not done so far. Thereafter, think of legal remedies.

A Divorce Petition can be filed even with in a week after marriage if there is Extreme Hardship which has to be pleaded specifically. Yesterday Mr. Laloo Pradad Yadav.s son also had filed for divorce basing on the reason of wife's extreme hardship after 6 month of marriage.. In case of absence of Extreme Hardship the Petition of divorce is not maintainable before a year from marriage.

RCR notice is a time tested tool to compel wife to raise true/false complaint of dowry/domestic violence against husband with family including married/unmarried brother/sisters wit/without their spouse. This way husband leaves her with no choice but to spoil his family even if she does not want to do so.

This forum is full of such cases where husband with parents/siblings faced such criminal charges.
After visiting jails people realise that the situation inside Indian Jails is not as rosy as shown in movies and the cops are also comedians in movies which is not in actual life.

Court may not force a spouse to live with other abusive spouse and may end the wedlock.
However a spouse may not run to court and any counsel must not prompt a client to run to court, empty handed.

Let your own very able LOCAL counsel opine on all instances, evidences that you have and affirm that these are irrefutable...
