Medicines not taken back and money not refund

Dear Sir/Madam,

I have bought some medicines in Thulasi Medicals on 13-Feb-2011 for the amount of 1514.00, the medicines are becoming allergic for my wife (so we stopped it), we have gone and requested the shop to take back the medicines and return the amount, we missed the bill, but having the payment charge slip of the payment done through ICICI and also the statement for the same.

THe address of the Medical shop is follows:

Thulasi Medicals
#4/5, Mount Poonamallee Road
Porur
Chennai -600116.

Please suggest or do us the favour to get back the money or advice us take procedures for legal actions.

Do you have Dr. Prescription??
If yes, ask Dr.
If No. were you regularly sing it or used on your ow first time??

You can Complaint to Manufacturer , informing what happened to your wife, and Co., will certainly react immediately. & do the necessary. Write Letter, E Mail with Batch No., Date mfd etc. ...

Dear Ilayaraja,

The chemist cannot be compelled legally to take back the sold out medicines unless the medicines are not as per prescription. It is the duty of the doctor to confirm from the patient before prescribing medicines if some medicine causes any allergy.

Normally chemists do not refuse to get back the medicines if substitute medicines are purchased on prescription by the doctor or even otherwise also. It seems some altercation would have happened between you and the chemist on account of which the chemist would have refused to take back the medicines.

Dear all,

Thaks for your valuable request. No arguements or fight between us. Me simply asked the chemist to take back the medicines and i am ready to purchase someother things, but he not even respect our words. may i take any consumer complaints over that company. I am having prescription, and the credit card statement and charge slip, even he checked all medicines are good.

Dear Ilayaraja,

I don't think you will be benefitted even slightly by lodging case with consumer forum. Just think, what sort of defect in service you would prove on the part of the chemist. In my views, you would be wasting your time and money in consumer forum case also merely with backfire on you.

You may however try to convince the chemist with the help of some local influential people about the medicines not being of any use to you and you would be ready to buy substitutes in lieu of the replaced medicines. However, if cash memo had also been issued to you, the same will also have to be returned to him for cancellation purpose.

Dhinga ji suggested you a short and peaceful approach.

As u have dr. presc as I suggested write to Manufacturer,
You can file Consumer case against [1]Dr,. and [2]manufacturer, party to [3]Thulasi Medicals.
Claim what allergy and loses incurred .
Publish in news paper.
Manufacturer will run after you.
Keep proof of allergy, get treatment M.D.

Dr Certificate and treatment for after effect. +Photo etc to prove your damages. & loss

Though you dd not reply all my Q, I suggest thses.
Manufactureer , as per Food & Drug Administration, bound to investigate even a single complain.
.If mfg co do not respond, directly complain to FDA.
