Dear sir, please advice me "whether a joint power of attorney holder could sign an agreement to develop a land as a single person or it is necessary to sign both of the power holders to execute the agreement where interest of both are involved"?
Adv. Sunil (Expert) 06 February 2012
It will come to know only after vetting the POA. If POA is drafted so as to give power Jointly and severally than yes any one of the POA holder can exeute the agreement.
Shailesh Kumar Shah (Expert) 06 February 2012
Read POA, if it severally authorise to do develop land then it could be done otherwise no.
Nadeem Qureshi (Expert) 06 February 2012
I agree with the experts
M V Gupta (Expert) 12 February 2012
I confirm the above views. If the powers are conferred jointly and severally, the Agreement can be executed either jointly or individually by any of the power holders.
Advocate. Arunagiri (Expert) 12 February 2012
When there are two POAs for a particular land, both of them has to sign the development agreement.
