sir but my brother have not taken or filed divorce.n one more thing he is out of country not in india .and becoz they people have loged complain against our family so i wanted to know can my brother file for a divorce now .and they have also send us a notice regarding maintainance .

It seems that you have opened a new thread instead of posting in your old query. Anyway, the divorce cannot be granted merely on the ground that the wife has filed the criminal case. The grounds for the divorce should be made cleared first.

so can he file a divorce case from other country.just by sigining the legal papers n send back to india.or else he should come here again n again.becoz the problem is her wife is harrasing him saying tat i willnt give u divorce also n not let u also to file for a divorce n even wont come also.

it is advisable that you consult a local lawyer and go by his advise . he can file for divorce through power of attorney . however for evidence he will have to come to india to prove his case

He can file suit for divorce from abroad as well. Only at the tie of his evidence he needs to come.

When a legislation comes only to satisfy whims of a group for sure it is to serve the purpose of exploitation in hands who have access to courts.
