I was given some money by a relative by bank transfer It was meant as a kind of lease amount for the house she was staying which jointly belongs to many of us. However there was no papers signed between us. When our relation turned sour, I returned the amount by check to her address But she did not en cash it Now she says she did not receive it (I sent it by speed post) and demanding it back immediately without giving her bank details without giving her address. There was no paper signed and even I was even told there is no need to pay back Do I need to pay it back immediately?

When cheque not encashed, the money is due and demanded, what is the hitch in payment. Pay the money under receipt.

If the cheque is outstanding, issue another if request received with confirmation that the old cheque no.....was not received by them / would be returned if received and would not be presented in any circumstances.

@XYZ, 1. Disclose your identity and do not post anonymous query, since the same are not entertained on this platform. 2. It is a vague query with incomplete information. 3.You have stated that the amount was transferred through bank as a kind of lease amount (in which capacity) where you had been sharing (were you a sharing tenant with other person). 4. The amount was sent through cheque but not encashed is no remittance. 5. Consult a local lawyer with full details of the case.

If the payment made by cheque was not encashed by her, you may ask her to either cancel the cheque or send it back so that you can issue her a fresh cheque or make payment by purchasing a DD on her name.
