(Querist) 20 July 2012 This query is : Resolved 
Hi,

1.If the mortgage agreement is not registered can the property be sold to third party.
2. In such case is there any claim on the property against the loaned amount. Will the property get attached if the person defaults.

Please advice.

!.Yes! it can be but property shall pass with all burdens of loan it has over its' head.
2 Certainly!Even attachment before judgement can be sought for by the creditor.
