Motor vehicle act

(Querist) 03 December 2013 This query is : Resolved 
Hi,
last week in a road accident one of my freind expired.some standby say he was looking like drunked.but as for my knowlege he was not drunked on the day,
when he was crossing road caught on behind wheel & died on spot.now if we have to put case how we have to go & what benift we can claim from lorry side.he was only bread winner of family.

On face of the facts disclosed, the deceased person was not driving any vehicle, but a pedestrian. If so, he is entitled for compensation. It makes no difference whether he was drunk or otherwise.

Have you read the FIR and POST MORTEM Report What does it say. Still You will get the Claims .They might argue to reduce the same basing on this
