It is over and enforceable when it is signed.
For the court cases, it needs to be exhibited in court.

you have been given copy of MOU signed by parties . at time of filing court will ask the parties whether they have signed MOU . advocates have to also sign . then only court will take it on record .
before filing request your opponent that you wan to compare orginal with xerox copy .

Demand MOU Ori Doc opp party want to rely upon ""
Sub: Inspection of Documents in the matter of R. C. Suit No. xxx of 2011 In The Court of the Honour Judge xxxxx
Dear Sir,
2) My client says that he preferred to Inspect all Original Document including MOU your client want to rely upon in the above matter, prior to the submission of Say, & W/S , and hearing of the same for defense.
Under the circumstances, you are called upon to offer an inspection of all the Original Documents your client rely upon, and issue me the TRUE COPY of all documents thereof at your earliest. My client is ready and willing to attend your office in my presence to obtain the same and pay for the copies thereof.
Kindly arrange for the same at your earliest, at least a day prior to the hearing of your Application for Interim Relief, and inform me the time, date and place for inspection accordingly.
Thanking You.

MOU shall be taken on court file subject to specific admission of both parties before the court so there is no likelihood of any type of fraud even if the signed MOU is lying in the file of lawyer for the opposite party.
