Movers and packers issue

I have send query in the past too and am very thankful to all of you for your kind support.
I have also a query open called cheating by chennai packers and movers.
I have sent a legal notice as directed by all of you and their lawyer responded that they have agreed on a sum of 45k which is what I had also mutually agreed subject to me receiving my washing machine intact.
I had written to them that since the machine is also missing I would need another 7k plus the legal fees. I told them I am ready to settle the matter for 52-55k. After my reply they have not yet replied.
I have got their document from their lawyer that they are in agreement for 45k amount. Now they are just keeping mum since I have put my demand. My Lawyer says now there's only one alternative i.e to move to a consumer court since they are not responding.
I fail to understand how they are trying to contact me for a settlement even though they have send a official legal reply to my notice wherein they have agreed for an amount. Now after my reply they are not responding.
Can I file in consumer court for mental agony and damages as well? Also will their legal reply be ample proof for the consumer court that they have agreed on a specific sum { since they have agreed on a sum means there's deficiency of service}
Also my lawyer tells me that a lawyer will cost me 40-50k to file in the consumer court which honestly I can't afford as I belong a a middle class family and the amount disputed also is around 70-80k which I had negotiated for 45k+ my washing machine cost.
I need some help legally and also its quite puzzling that they are mum over this issue or is it they are thinking that I will let it go.

DEAR Querist
no need to worry, you can file a complaint before consumer court your self based upon their reply & actual facts. you can save litigation cost too

search web, you would be able to get lot knowledge about consumer forum, procedure etc. Better engage a lawyer, negotiate the fees may be it comes to your expectation.
