Multiple sale agreement

(Querist) 16 December 2011 This query is : Resolved
sir,

we finalize a business deal with landlord for his house and six month sale agreement has been signed both parties and later we came to know that he signed another sale agreement of our agreement with in one month time the landlord
has been signed another sale agreement with other person but he did not registered any sale document so what can we do? its illegal or legal ? if its illegal can we sue the landlord for multiple sale agreement ?
pls advice

is your agreement duly registered . has any consideration changed hands? what are the terms of agreement ?

have you made payment as per agreement ?

what do you mean by six month agreement ?

if landlord has signed agreement with you he cannot sell the said property to another person . issue him a legal notice .

In the given case, you should file a suit for specific performance as your agreement was made earlier and subsequent agreement has been made violating the earlier agreement.

you have not stated the state in which the property is situated. If it is in Maharashtra the agreement needs to be stamped and registered. if it is not done so, the agreement may not be admissible in court AND WILL BE IMPOUNDED if produced in the court in which case full stamp duty with peanlty wiil have to be paid. You may also consider filing a complaint with the police for cheating.

I endorse the views of Shri Makkad.
