Muslim divorce and hindu wedding

(Querist) 10 February 2015 This query is : Resolved
Hello,

By birth I was born Muslim, my mother divorced and re-married a hindu (Gupta) 8 years after her marriage/ My birth name was Mohammad Faiz and later changed into Ankit Gupta, we follow both religions. However, At the age of 22 I was married to a muslim girl and followed muslim law in 2005 (nNikah). I am not happy with her and dont love her. I want to divorce her and re-marry as per hindu law to another girl.
I have mentioned "talaq" three times on a mobile text to my wife. I have following queries, please guide me for a valid procedure going forward -
Do I need a talaqnama for valid talaq from my wife (I am sunni muslim)?
For Hindu court marriage is it mandatory to have a talaqnama?
Do I need to provide a valid reason for my divorce?
Do I need to wait for second marriage after talaq or I can do it anytime after divorce?

Thank you in advance for helping me on this matter.

You are a Muslim and cannot have the laxury of claiming that you follow both the religions in contracting the marriage of your choice.

If the Marriage was Performed as Per Muslim Customs Only Muslim Laws would be applicable.Consult your Local Good Advocate.

1. Preferably Talaque before Quazi.
2. A Hindu can not marry if having one wife alive.
3. Law is to be followed as per its provisions.
4. No wait required. Muslim can have more than one wife.

As a Muslim, your marriage and subsequent divorce by pronouncing talaaq is valid. If you want to marry a Hindu after that, you either have to convert to Hindu or can marry under special marriage act. For both the things, you should not have a wife through a subsisting marriage. Make things more clear by clarifying from a local advocate and proceed.
