Mutation rejected by tehsildar

(Querist) 09 April 2013 This query is : Resolved 
MY sister bought a 693 sq. yd. plot in 2001 in UTTRAKHAND ( HARIDWAR ) & got it registered by registrar of concerned KACHERI. As mutation was not got done as she had NO IDEA & no body informed for doing the same. In 2013, when she approached for getting MUTATION for the said plot, the tehsildar denied for MUTATION & told the land has gone into ``fragmentation` so its mutation is not possible.

Some of other applicant got the MUTATION done earlier and as we got know that for some time it was opened.

Now, the lawyer sitting there was telling , if you will apply for MUTATION the land will be acquired & it also happened in one case. As land size is bigger & plotting was done after converting agriculture land into residential area.

How can my sister get MUTATION & WHAT WILL HAPPEN IF SHE WILL CONSTRUCT HOUSE THERE ? Please inform in DETAIL.

If your sister is land owner than she is entitled to get mutation of the same.
File Writ in the high court for getting necessary relief.

if you sister is holding the required papers then she can file a writ and only small matter it will decide at earlier stage it self

Tehsildar is right in his approach if the land has been consolidated but if only fragmentation has been made then the ownership rights of your sister cannot be ended. Now filing a writ petition before Uttrakhand High Court is the only remedy before you.
