My Aunt is staying as a guest, now refuses to leave the hous

Querist : Anonymous (Querist) 13 March 2018 This query is : Resolved
Dear lawyers, my Aunt has been staying with us as a guest for free, for several years now. We gave her a room in our house and allowed her to use our kitchen. Apart from this, she has also been using our electricity for free. After my marriage, we found that we were falling short of space and asked her to vacate her room. She now refuses to vacate saying that this is her house now as she has been staying for so long and there is no law that can make her leave the house.

Please suggest what suitable action I can take to evict her.

Thanks

The facts given by you seem to be quite insufficient, i.e., your father's sister, your father's brother's wife or any other aunt and the reason you allowed her to live.

However, if the house is in the name of his father, her right to live in that house cannot be denied.

further whose property was this? who acquired it?

The house is on mine and my mother's name. Aunt is my father's sister.

You can give her legal notice to vacate the house.

You have not stated the reason of allowing your aunt to live in your house. Is it your real problem or some hypothetical academic query?

The real reason for allowing her to stay was compassion. This is genuine, not hypothetical. My Aunt is neither a tenant nor the owner, what kind of legal notice can I serve her??? Thank you all for your support and replies.

file eviction suit.

Don't try to work on hit & trial basis at your own. Get the help of some local lawyer. So, kind of legal notice will be the headache of your lawyer.
