My girlfriend and her rich father are intimidating me

(Querist) 11 August 2012 This query is : Resolved
My girlfriend and her wealthy father both are intimidating me over email, txt messages and phone calls to repay the amount my girlfriend sent me for the treatment of my old parents when we were in good terms. That time she sent the money stating that it should not be repaid as I belong to a simple middle class family. Now that when things have ended between us she and her father is threatening me to repay the amount as soon as possible or else they would file a suit against me. Please advice on what I should do and whether they can harm me. When she sent the money she did not send the money in her name but used two other names of persons whom I don't know at all.

A gratuitous transfer of money on account of love is not a LOAN, and need not be returned back.
Sudhir Kumar, Advocate (Expert) 12 August 2012
But if the transfer of money was on the promise of marriage then you may be in fro dowry act violation.

Do we read queries before we answer?
I go with Adv. Bharat Chugh.

But wish to inquire from you the mode and date or year in which the money was received?
Guest (Expert) 12 August 2012
But, to supplement the replies of S/Shri Bharat Chugh and Prabhakar Singh ji, would you be able to prove the money to be the gratuitous transfer of money, i.e., have you any written proof that she stated that the money should not be repaid? Also, if the money was transferred through cheque or bank draft, but you don't have any proof of gratuitous transfer of money, your liability to repay won't be over.

Still further, it also depends upon the accounting of the transaction, as to how could you show that money in to your account for the purpose of Income Tax.

Of course, the contents and language of your replies, if any made, to their messages would also matter much in your case.
