My mother's name not being added in bank account in place of my demised father

My father's name is in nominee of a bank account, the other nominee is my uncle and account is in name of my grandmother. After death of my father we asked grandmother & uncle to sign on the bank application form for adding my mother's name in place of my father's name. But they denied. And are using all the money being deposited(fixed rent is being deposited) in the account. My father shared equal right over the money in account.
What should I do further? Kindly help me.

You need not do anything, as your father was merely a nominee of your grand mother, not sharing any right during the life time of your grand mother. Your grand mother can nominate someone else also and enjoy the right even to remove the name of your uncle as a nominee from her account.

First Obtain Legal Heir Certificate and Proceed Legally.Nominees could be Legally held responsible for Misuse of Money and Even the Bank Could be held Responsible.Consult your Local Good Advocate.

Dear N.J.S. Rajkumar,

The account holder, his grandmother is still alive. Hence, question of use or misuse of money by any nominee does not arise during the life time of the account holder, as any nominee does not enjoy any right to withdraw money out of the account unless duly authorises.

If the nominee has deceased the owner of the a/c has full right to add anyone's name in nomination as many times.


Nominee has no right on funds in a/c of owner of the a/c, during the life time of the owner of a/c.

Not as a matter of pointing out any mistake, rather, it was my attempt to draw your attention towards a hidden point, as the author did not specifically mention that her grand mother, the account holder, was still alive. It could only be detected from a hint, where he pointed out that her grand mother refused to change the nomination in favour of his mother, when he stated, "After death of my father we asked grandmother & uncle to sign on the bank application form for adding my mother's name in place of my father's name. But they denied."
