my mothers part in her inherit property

My mother has one brother, her father died in 2001 now her mother (my nani) is the owner of the land so can my mother ask for the property partition because as the supreme court say that the death before 2004, women have no right to ask for partition on her fathers property. So is she have the right on inherit property or not?
